Terms of Use

These Terms of Use govern your access to and use of the Suretiform website and the services introduced through it. The website is an informational and marketing platform: it presents the offer, collects registration details with your consent, and connects members with the services described. Trading transactions are executed with the relevant licensed legal entity providing each service, whose details are disclosed during onboarding. By creating an account or using the website you accept these terms.

1. Use of the website and services

You may use the website and the services introduced through it for their intended purpose: learning about the platform, registering an account, operating strategies within your verified membership, and managing your funds. You agree to use the website only for lawful purposes and only as these terms and our policies describe. Access to certain functions requires completing identity verification under our KYC/AML policy, and we may adjust available functions to match your verification status.

2. Restrictions

You may not copy the platform's content for commercial redistribution, resell access to services without agreement, extract data by automated scraping beyond what your browser normally does, or interfere with the platform's operation. Access to the services is personal to your verified identity; sharing an account, lending credentials, or operating on behalf of an undisclosed third party is outside the terms. Where we detect restricted use, we may limit functions while we investigate and communicate with you.

3. Advertising materials and information emails

With your consent, we may send you service messages and, if you opt in, marketing materials: platform updates, market commentary and offers related to the services. Every marketing email identifies us plainly, links to a working unsubscribe mechanism, and stops when you use it. Transactional messages about security, verification and withdrawals are not marketing and cannot be opted out of, because they protect your account and your money.

4. Intellectual property

The Suretiform name, logo, website design, text, graphics and the platform's software are protected by intellectual property rights owned by us or our licensors. You receive a limited, revocable, non-exclusive right to use the website as intended; everything else is reserved. Nothing in these terms transfers ownership to you, and you may not use our marks, design or content to imply association, endorsement or partnership without written permission.

5. Confidentiality

Each party protects the confidential information of the other. Yours includes the personal data and documents you entrust to us, handled under the Privacy Policy. Ours includes non-public details of the platform's models, operations and security measures. The obligation survives the end of your membership and applies to information obtained through the services, whichever side of the conversation you sit on.

6. Links to other websites

The website and our communications may link to third-party websites, such as payment providers or official sources. Those websites are outside our control, and linking is convenience, not endorsement. Your use of a third-party site is governed by its own terms and privacy policy, and we recommend reading them, especially where money or identity documents are involved.

7. Prohibited use

You must not use the website or services to breach any applicable law; to transmit spam or unsolicited commercial messages; to attack, probe or disrupt the platform's infrastructure, including attempted unauthorised access; to infringe intellectual property rights; to launder proceeds of crime or finance unlawful activity; or to assist anyone doing these things. Prohibited use can lead to immediate suspension, closure of the account, reporting to the relevant authorities where required, and handling of any remaining funds as the applicable framework directs.

8. Support

Support is available by email at [email protected] during Monday to Friday, 9:00–17:30 NZST, with every member additionally supported by a personal manager. We aim to answer standard queries within one business hour and to never leave a legitimate question without a substantive reply. Formal complaints follow the dedicated Complaints procedure rather than general support queues.

9. Disclaimer of warranties

The website and its content are provided for information about the platform and its services. While we work to keep content accurate and current, we do not warrant that the website will be uninterrupted, error-free, or complete at every moment, and information may change as services and requirements evolve. Nothing on the website is investment advice, a recommendation, or a promise of performance; markets involve risk, including loss of capital, as described in the Risk Disclosure.

10. Limitation of liability

To the maximum extent permitted by applicable law, our liability for claims connected with the website and the services is limited to the amount of fees you paid to us for the services giving rise to the claim in the twelve months before the event. We are not liable for indirect or consequential losses, lost profits, or losses arising from events outside our reasonable control, including third-party provider failures and market movements. Nothing in these terms excludes liability that cannot lawfully be excluded, including under New Zealand consumer law.

11. Indemnification

You agree to indemnify us against losses, claims and reasonable costs that arise from your breach of these terms, your violation of applicable law, or your misuse of the website or services, provided we promptly notify you of the claim and cooperate reasonably in its defence. This clause works alongside, not instead of, the rights each party otherwise holds.

Other provisions

These terms and your use of the website are governed by the laws applicable in New Zealand, with disputes resolved under the escalation described in the Complaints procedure before any court or external scheme is engaged. If a provision of these terms is held unenforceable, the remainder stays in force. We may update these terms as the platform and applicable requirements evolve; the current version is always published here, updates are announced in the platform, and the version in force when you acted is the version that governs that action. Continuing to use the website after a change takes effect means you accept the updated terms. Questions about anything in this document go to [email protected].
